Removes the requirement that a public street or highway be outside city limits as a defense to operating an all-terrain vehicle on public roads.

Maintains three affirmative defenses for all-terrain vehicle operators: the road is not an interstate highway, traveling on it was the most reasonable route of access available, and the purpose was to travel between off-road trails or from private property to an off-road trail.

Defines "private property" to include owned property, leased property, residences, and properties where the operator is staying as an invitee (vacation resorts, rental cabins, deeded timeshares, or right-to-use timeshares).

Clarifies that possessing a valid driver's license or motorcycle operator's license is not a defense to prosecution for this violation.
