HB1585 - Delivery Network Company Insurance Act

• Creates the Delivery Network Company Insurance Act as a new subchapter in Arkansas Code Title 23, Chapter 13, establishing insurance requirements for delivery network companies and drivers

• Requires delivery network companies to maintain primary motor vehicle liability insurance during delivery availability periods and delivery service periods with minimum coverage of $50,000 per person/$100,000 per accident for bodily injury and $25,000 for property damage

• If a driver's personal insurance lapses or excludes delivery services, the delivery network company's insurance must provide full coverage from the first dollar of a claim and cover the duty to defend

• Requires delivery network companies to disclose in writing to drivers what insurance coverage they provide and that the driver's personal policy may not cover them during delivery periods

• Permits licensed insurers to exclude coverage for claims occurring during delivery periods while allowing them to seek recovery from the delivery network company's insurer for excluded claims

• Effective October 1, 2024
