HB1604 Summary

• Requires school district boards to place all student transfer petitions on the agenda of their next regular monthly meeting or specially called meeting, whichever occurs first

• Mandates the superintendent notify the board at least 5 days before the meeting of all transfer petitions and provide written recommendations, including detailed explanations for any recommended denials sent to parents or guardians

• Requires each transfer petition to be considered individually with a separate board vote, and gives parents, legal guardians, or persons standing in loco parentis at least 5 minutes to present their case

• Allows boards to delegate approval authority to the superintendent or individual board members, but prohibits delegation of denial authority; provides that denied transfer decisions may be appealed to the State Board of Education

• Updates terminology throughout the statute from "children" to "student" and "parents" to "parent, legal guardian, or person standing in loco parentis"
