Division of Correction shall reimburse counties from the County Jail Reimbursement Fund for the actual cost of housing state inmates when unable to accept inmates due to insufficient bed space.

Division of Community Correction shall reimburse counties for actual costs of housing inmates when unable to accept inmates due to insufficient bed space or when an inmate is confined in a county jail under a prerelease program or sanction for violation of supervision conditions.

Reimbursement rates are determined by the Chief Fiscal Officer of the State after consultation with Arkansas Legislative Audit and the Division of Correction, and upon approval by the Governor, until appropriations are exhausted.

Reimbursement amounts shall include the county's cost of transporting inmates to the Division of Correction.

Reimbursement accrual begins on the date of sentencing (or date of probation placement with incarceration for Community Correction cases), but divisions shall not reimburse until receiving a complete and accurate sentencing order or relevant sanction order.
