AR HB1790

Amends Arkansas Code § 5-26-303(a)(5)(B) to include convictions for aggravated assault on a family or household member within the 10-year lookback period when determining if a person has two prior domestic battery or assault convictions that elevate the charge to domestic battering in the first degree.

Expands Arkansas Code § 5-26-303(b)(2)(B)(ii) to add aggravated assault on a family or household member as an offense that, when committed within 5 years of a domestic battering in the first degree charge, can elevate that charge to a Class A felony.

Expands Arkansas Code § 5-26-304(b)(2)(B) to add aggravated assault on a family or household member as an offense that, when committed within 5 years of a domestic battering in the second degree charge, can elevate that charge to a Class B felony.

Allows convictions from this state, other states, or foreign jurisdictions for equivalent penal laws to count toward the prior offense requirements in all amended sections.
