State board shall use the same criteria for public school district waivers as used for open-enrollment public charter school waivers when granting or denying petitions within 90 days of receipt.

Division of Elementary and Secondary Education may request additional information from a public school district, with the state board having 90 days from receipt of that information to grant or deny the waiver petition.

Waivers granted to public school districts shall be valid for a duration not exceeding 5 years and not to exceed the duration of the corresponding open-enrollment charter school waiver.

State board may revoke a waiver only upon showing cause and must provide at least 15 business days' written and electronic notice to the superintendent and board president, including the specific reason for revocation.

Failure to provide proper notification results in a waiver of the state board's right to revoke until notification requirements are met.
