SB 210 Summary

• Expands the definition of "Gas" in Arkansas underground storage law to include carbon oxides, ammonia, hydrogen, nitrogen, and noble gas in addition to natural gas.

• Adds "Gas storage facility" as a defined entity authorized to capture, produce, or store gas and grants these facilities the same eminent domain rights previously reserved for natural gas public utilities.

• Removes the "Native gas" definition from the primary definitions section and relocates it within the statutory framework.

• Applies all existing underground gas storage regulations, condemnation procedures, certificate requirements, and ownership provisions to the newly included gases.

• Effective date: February 24, 2023.
