AR SB270

Adds a new Class C misdemeanor offense for individuals 18 years or older who knowingly enter or remain in a public changing facility assigned to the opposite sex for sexual gratification purposes while a minor of the opposite sex is present, with exceptions for parents/guardians, maintenance personnel, medical assistance, and law enforcement.

Defines "sex" as a person's immutable biological sex determined by anatomy and genetics at birth, and specifies that "public changing facility" includes restrooms, bathrooms, locker rooms, and shower rooms but excludes private commercial dressing areas.

Establishes that felony violations of sexual indecency with a child can be prosecuted at any time (removes statute of limitations), while misdemeanor violations (including the new changing facility offense) remain subject to normal prosecutorial timeframes.

Makes felony sexual indecency with a child violations subject to additional fines when committed against or in the presence of a child, and excludes misdemeanor violations from various sex crime registries, background check disqualifications, and employment/licensure restrictions.

Modifies numerous state code sections to consistently carve out misdemeanor sexual indecency with a child violations from sex offender registration requirements, health professional disqualifications, and other statutory provisions affecting employment and licensing.
