Wholesale distributors cannot limit or terminate sales of controlled substances to licensed providers or pharmacies unless they file a formal written complaint with the appropriate licensing board containing specific allegations and prescription-level details.

Once a complaint is filed, the distributor must wait for the licensing board to take administrative action against the licensee before restricting distribution.

Distributors may voluntarily terminate relationships with 120 days written notice, or providers/pharmacies may terminate with 120 days notice.

Distributors may flag suspicious individual orders exceeding clearly identified thresholds if reported the same day to the Arkansas State Board of Pharmacy, but flagging may only limit sales, not terminate relationships.

Violations carry a minimum fine of $100,000 per violation and may include license revocation; the Arkansas State Board of Pharmacy must adopt implementing rules by January 1, 2024, and the act takes effect immediately upon approval.
