Amends Arkansas Code § 25-19-105(a)(3) to require records custodians to respond in writing to written public records requests within the required timeframe

Custodians must respond in writing in three circumstances: (A) stating no records exist if none are responsive; (B) identifying applicable exemptions if responsive records are subject to exemptions; or (C) identifying the appropriate custodian if they lack administrative control over responsive records

Allows custodians to deliver their response to requestors by electronic mail

Makes custodians who knowingly fail to respond as required subject to penalties under Arkansas Code § 25-19-104 for violation of the Freedom of Information Act

Clarifies that the new requirements do not eliminate the custodian's obligation to immediately provide responsive records not in active use or storage
