SB388 Summary

• Establishes the Peer-to-Peer Car-Sharing Program Act (§ 27-25-101 et seq.) to regulate peer-to-peer car-sharing platforms that connect vehicle owners with drivers for financial consideration.

• Requires peer-to-peer car-sharing programs to maintain minimum motor vehicle liability insurance coverage of at least the amount required under § 27-22-104 during each car-sharing period for both shared-vehicle owners and drivers.

• Permits insurers to exclude coverage for shared vehicles under personal motor vehicle liability policies, and establishes that peer-to-peer car-sharing programs assume liability for bodily injury, property damage, and uninsured/underinsured motorist losses during the car-sharing period.

• Mandates peer-to-peer car-sharing programs collect and retain records of car-sharing periods, pickup/drop-off locations, fees, and revenues; verify drivers hold valid licenses; verify vehicles have no unrepaired safety recalls; and provide specified consumer protection disclosures.

• Grants municipal airports and regional airports authority to impose regulations, tolls, and fees on peer-to-peer car-sharing programs; exempts peer-to-peer car-sharing programs and vehicle owners from vicarious liability consistent with 49 U.S.C. § 30106.
