Motor vehicles operated in a race or drag race on a public highway may be impounded at a law enforcement officer's discretion when issuing a citation for a subsequent offense within 5 years of a prior offense under Arkansas Code § 27-50-309(b)(1)(A) or (c)(1).

Impoundment costs are the responsibility of the registered vehicle owner.

Law enforcement agencies must follow their established towing policy, use a towing rotation list if applicable, and comply with existing towing and storage regulations under § 27-50-1207 and § 27-50-1201 et seq.

An inventory of the vehicle's contents must be taken at the time of impoundment.

The vehicle owner, operator, or person in charge may contest the impoundment and must be notified of this right at the time of impoundment consistent with § 27-50-1207.
