HR 1049 Summary

• Speaker of the House must appoint a designated survivor from House members before any joint meeting where all General Assembly members and constitutional officers are invited.

• Designated survivor must rank in the top one-third of House seniority and meet all qualifications to serve as Governor under Arkansas Constitution, Article 6, § 5.

• Designated survivor assumes all powers and duties of Speaker if the Speaker dies, becomes ill, incapacitated, or is otherwise unable to serve and a majority of House members cannot serve.

• Designated survivor must leave the State Capitol Building at least 30 minutes before the joint meeting starts and remain at least 5 miles away until 30 minutes after it concludes; the Speaker must notify the Division of Emergency Management of the location.

• Designated survivor is counted as present for attendance and quorum purposes and is eligible for mileage and per diem compensation related to service as designated survivor.
