Healthcare insurers are prohibited from requiring step therapy or fail first protocols for noninvasive ventilators when the device requires frequent servicing, clinical evidence suggests alternatives would be less effective or cause adverse reactions, or the FDA deems it medically necessary

Applies to individual, group, and blanket health plans, including Arkansas Medicaid, the Arkansas Health and Opportunity for Me Program, and state/public school employee health plans

Medicaid managed care organizations must reimburse for noninvasive ventilators at no less than 100% of the Arkansas Medicaid Program fee schedule

Grants rulemaking authority to the Insurance Commissioner, Secretary of the Department of Human Services, and State Board of Finance for implementation
