AR SB282

Allows customers of public water systems serving 5,000 or more people to hold elections on whether to fluoridate their water supply

Elections can be triggered by petition (requiring signatures from 5% of voters in the last county judge election) or by majority vote of the county quorum court

Petitions must be filed at least 120 days before a general election, and subsequent elections on the same issue cannot be held for at least 4 years

If a majority of voters in a majority of counties served by the water system vote against fluoridation, the system must cease fluoridation within 30 days of certification

Public water system boards may independently elect to prohibit fluoridation, but voter election results supersede any board decision
