Defines "cargo" as goods, money, or baggage that constitutes commercial freight moving in commerce from pipelines, railroad cars, trucks, storage facilities, vessels, aircraft, warehouses, or freight distribution facilities, excluding direct-to-consumer goods

Creates an enhanced penalty of up to 10 additional years of imprisonment for theft of cargo when the underlying offense qualifies as Class B, Class C, or Class D felony theft

Requires prosecutors to provide written notice to defendants that they are subject to the enhanced sentence, which may be included in the information or indictment

Enhanced sentences for cargo theft must be served consecutively to any other sentence, and convicted persons are ineligible for earned release credits on the enhanced portion

Declared an emergency and approved March 18, 2025, taking effect immediately to address theft of goods moving in commerce as a pervasive problem harming businesses and consumers
