Removes the moratorium that has been in place since July 1, 2005, which prohibited the Health Services Permit Agency from accepting applications to add new beds or expand bed capacity at residential care facilities

Creates an exemption allowing psychiatric residential treatment facilities (as defined in § 9-28-402) to add new beds or expand existing bed capacity

Prohibits setting any cap on the number of beds or bed capacity for psychiatric residential treatment facilities in Arkansas

Expires the existing moratorium on psychiatric residential treatment facility bed construction that was set based on permitted and licensed beds as of February 1, 2008, under 20 CAR § 255-605
