Public records involving railroad fatalities must be maintained in a manner that keeps personal information of railroad crew members confidential, with such information redacted from any publicly disclosed documents

Confidentiality protections do not apply to requests from the host or employing railroad, law enforcement officers, Arkansas state attorneys, Arkansas Department of Transportation staff, or federal transportation safety agencies

Persons authorized by court order may also obtain unredacted crew information

Authorized requestors (except the employing railroad and federal agencies) may only access the information if necessary for performance of their official duties, and requests must be submitted in written or electronic form

Approved April 21, 2025, the act aims to prevent harassment or assault of rail crew members involved in railroad fatalities
