Petroleum wholesalers may report businesses with delinquent payments to the Division of Environmental Quality within 2 business days, providing the business name, address, sale date, amount owed, and wholesaler information.

The Division must "red-tag" reported businesses and maintain a delinquent list; petroleum products cannot be delivered to red-tagged businesses until the tag is removed.

Delinquent businesses must pay outstanding fees via cash, electronic transfer, money order, cashier's check, certified check, or bank exchange to be removed from the list.

Wholesalers must report full payment receipt to the Division by the next business day, triggering removal of the red-tag.

Businesses disputing their delinquent status may file a written statement with the Division explaining why the delinquency should not exist; the Division reviews statements from both parties to determine whether to remove the red-tag.
