Creates new criminal offense of "theft of equipment rental services" covering three acts: keeping equipment after lease expiration, damaging rented equipment so it requires repair, or failing to pay for time equipment was controlled

Penalties scale by value: Class B felony ($25,000+), Class C felony ($5,000-$25,000), Class D felony ($1,000-$5,000), Class A misdemeanor ($1,000 or less)

Provides affirmative defense if the person compensates the lessor for both the rental value during unauthorized possession and any equipment damage

Requires mandatory restitution to equipment lessors for rental value and damage, in addition to any other sentence imposed
