Hospitals may hold only one retail pharmacy permit per licensed hospital location, replacing the previous blanket prohibition on nonprofit, tax-exempt, or governmentally funded hospitals holding such permits

Eligibility for a retail pharmacy permit is limited to hospitals providing only inpatient services and emergency medical care with a minimum average daily census of 24 patients

Hospital retail pharmacies must be located on the hospital campus within 250 yards of the licensed facility and must provide 24/7 access to emergency medications

Hospitals cannot obtain a retail pharmacy permit if an existing retail pharmacy already operates within 250 yards of the hospital campus and provides 24/7 emergency medication access

Pharmacy permit holders are prohibited from entering contracts with parent entities that create anticompetitive advantages, including preferential reimbursement rates, patient financial incentives not offered at other pharmacies, or limited provider networks; violations result in immediate permit termination and constitute unfair trade practices
