Adds new definition of "eligible child" to clarify benefits for unmarried children of deceased members under age 18, up to age 23 if full-time students, or disabled children who became disabled before age 23.

Adds definition of "employer" as departments, agencies, or political subdivisions that make contributions to the plan on behalf of elected officials.

Restricts credited service to exclude uncompensated periods where no contributions are made and limits credited service to a maximum of 12 months per year.

Revises survivor pension provisions to require surviving spouses to file written applications and removes the two-year marriage requirement for active or inactive members who die before retirement.

Adds provisions allowing courts to order restitution or fines from plan payments for members convicted of theft, embezzlement, fraud, or misappropriation, with criminal penalties for falsifying plan records.

Eliminates special health insurance premium benefits for retirees living in nonservice areas that were set to expire June 30, 2009.

Makes the elected officials' retirement plan a jural entity capable of suing and being sued.
