Prohibits smoking in motor vehicles when a person under 16 years of age is present in the vehicle.

Law enforcement officers cannot stop or cite a driver solely for this violation; they must have reasonable cause to believe there is another motor vehicle law violation occurring.

First violation results in a civil penalty of $50 per minor in the vehicle; subsequent violations result in a $100 penalty per minor in the vehicle.

Classified as a nonmoving civil traffic violation, and officers must verify that a minor under 16 is present before issuing a citation.
