Requires courts to place persons convicted of personal possession or use of controlled substances or drug paraphernalia on probation if the evidence was obtained during a drug-related overdose situation involving the defendant or another person seeking medical assistance.

Exempts individuals eligible for probation under this section from the restrictions in section 13-901.01, subsection h, paragraph 4.

Mandates automatic setting aside of the judgment of guilt upon successful completion of probation.

Applies to defendants who were either experiencing a drug-related overdose themselves or were in good faith seeking medical assistance for another person experiencing an overdose.
