HB 2623 Summary

• Amends Arizona law to allow county attorneys and attorneys general to issue subpoenas for grand jury witnesses without prior grand jury authorization, provided they report the issuance to the grand jury foreman within 10 days and to the presiding judge within 10 days.

• Requires that grand jury subpoenas be designated with a standard identifying grand jury number and that a duly impaneled grand jury be in existence at the time of subpoena issuance.

• Creates a new statute establishing that subpoenas duces tecum (for records) in criminal investigations require prior grand jury authorization before issuance by prosecutors.

• Provides that objections to subpoenas duces tecum may be filed in court under Arizona Rules of Civil Procedure Rule 45 for records inspection or copying.
