HB 2640 - Consolidated Insurance Programs

• Adds chapter 10 to Title 20 of Arizona Revised Statutes establishing requirements for consolidated insurance programs (wrap-up insurance) that combine liability and workers' compensation coverage for construction projects.

• Requires quarterly claims reporting to participants, limits deductibles to $2,500 maximum, mandates full funding of self-insured retentions, and prohibits monetary assessments for safety violations.

• Mandates general liability coverage include completed operations liability for up to 10 years after project completion, provide severability of interest, and give participants equal shared limits as the sponsoring participant.

• Requires workers' compensation coverage to include all workers at the construction site and prohibits requiring injured workers to return to employment unless their treating physician certifies fitness and the employer has pre-injury job or modified work available.

• Amends section 23-961 to allow employers to meet workers' compensation requirements by participating in a consolidated insurance program that includes workers' compensation coverage.
