Voids and renders unenforceable any covenant, provision, or understanding in transportation contracts that indemnifies, holds harmless, or defends a shipper from liability for losses or damages resulting from the shipper's negligence or intentional acts.

Applies to all contracts of transportation between private parties for compensation or hire, including agreements for loading, unloading, transporting, or storing property.

Excludes agreements where the state or its political subdivisions are parties and excludes agreements between railroads or intermodal service providers relating to interchange, use, or possession of intermodal equipment.

Defines "contract of transportation" to include property transportation for compensation, carrier entrance on property for loading/unloading, and services incidental to transportation such as storage.
