HB 2745 Summary

• Requires pregnant prisoners be restrained using only the least restrictive restraints necessary when prison employees or agents know of the pregnancy.

• Prohibits use of restraints on prisoners in labor, delivering, or recuperating from delivery unless there is compelling reason to believe the prisoner is an immediate threat to herself/others or a substantial flight risk that cannot be contained by other means.

• If restraints must be used during labor or delivery, only the least restrictive restraints necessary to ensure safety and security may be applied.

• Defines "prison" to include jails, private prisons, correctional facilities, secure care facilities, and juvenile detention centers.

• Defines "prisoner" to include any person, including juveniles, committed, detained, or held in a prison.
