Cities and towns with populations of 75,000 or more must operate curbside recycling programs for single-family residences by 2012 and implement curbside recycling for multifamily dwellings by 2014 (or by 2011 if curbside recycling already exists for single-family residences).

Cities and towns may offer financial incentives or waive code penalties to encourage multifamily dwellings to retrofit waste collection facilities for recycling, but cannot waive the requirement to provide recycling containers.

Property owners of multifamily dwellings must provide written recycling information to tenants in both English and Spanish, using materials developed and provided by the city or town.

Cities and towns may impose civil penalties on property owners who fail to comply with recycling ordinances, with maximum penalties ranging from $1,000 (for 25 or fewer units) to $5,000 (for more than 100 units) based on the number of residential units.
