AZ HCR2010

Proposes constitutional amendment to amend Article IV, Part 1, Section 1 of Arizona Constitution relating to legislative power and the initiative and referendum process.

Repeals provisions from 1998 Proposition 105 that prohibited the legislature from repealing, amending, or diverting funds from initiative or referendum measures approved by voters without a three-fourths vote in each house.

Restores broader legislative authority by allowing the legislature to enact measures that supersede initiative or referendum measures if the superseding measure furthers the original purposes and receives a three-fourths vote in each house.

Clarifies the legislature retains its right to refer measures to the people at the polls without restriction.

Requires submission of the proposition to voters at the next general election.
