HCR 2036 Summary

• Proposes constitutional amendments to allow the legislature to modify voter-approved initiative and referendum measures that mandate state expenditures or create dedicated funding sources without meeting the usual three-fourths vote requirement.

• Adds exception language to Article IV, Section 1 stating that protections for voter-approved measures are subject to the new conditions in Article IX, Section 23, Subsection C.

• Establishes a deadline of December 31, 2012 for voter-approved measures from November 3, 1998 through December 1, 2004 to propose new revenue sources through initiative or referendum; if no revenue source is approved by that date, the legislature may modify or repeal the program by majority vote.

• Allows the legislature to reduce mandated expenditures in any fiscal year if identified revenue sources fail to fully fund the spending requirement, subject to these new conditions.

• Requires submission of the proposition to voters at the next general election.
