SB 1088 Summary

• Amends Arizona Revised Statutes section 13-504 regarding discretionary transfer of juveniles from adult court to juvenile court.

• Removes the requirement that discretionary transfer hearings only apply to violations of title 13, chapters 14 or 35.1, making transfer discretionary for any offense.

• Requires the court to hold a transfer hearing if a juvenile is prosecuted as an adult for an offense committed more than twelve months before the criminal charge is filed.

• Maintains the standard that courts must find by clear and convincing evidence that public safety and juvenile rehabilitation would be best served by transferring the case to juvenile court before ordering such a transfer.

• Preserves the ten-factor analysis for judges to consider when determining whether transfer serves public safety and rehabilitation, including offense seriousness, juvenile's record, prior commitments, gang involvement, victim views, and likelihood of rehabilitation through available services.
