SB 1126 Summary: Intrastate Nuclear Fuel Act

• Declares nuclear reactor fuel produced entirely within Arizona's boundaries using equipment manufactured or obtained within the state has not entered interstate commerce and is not subject to federal regulation.

• Excludes basic materials and generic insignificant parts (screws, nuts, bolts, springs, etc.) from federal interstate commerce regulation when used in nuclear reactor fuel production within the state.

• Exempts intrastate nuclear reactor fuel production from federal licensing, certification, registration, and other federal qualification requirements under Congress's authority to regulate interstate commerce.

• Applies only to nuclear reactor fuel produced from basic materials mined or extracted within Arizona without significant component materials imported from other states or nations, effective September 30, 2010.

• Asserts that intrastate commerce regulation is reserved to the states under the Ninth and Tenth Amendments to the U.S. Constitution and Arizona's 1912 statehood compact.
