SB1206 Summary: County Planning and Zoning

• Repeals the old county planning and zoning statutes (Title 11, Chapter 6, Articles 1-2) and replaces them with comprehensive new articles establishing county comprehensive planning requirements, zoning ordinances, subdivision regulations, and development procedures.

• Creates mandatory county planning and zoning commissions with specific composition rules based on supervisorial districts and requires adoption of long-term comprehensive plans containing elements for land use, circulation, water resources, energy use, open space, growth areas, environmental planning, and development costs.

• Establishes county zoning authority including overlay zoning districts, conditional uses, retirement community zoning, and adult-oriented business regulation, with specific restrictions on dedications, exactions, and takings in compliance with U.S. Supreme Court decisions.

• Provides procedures for comprehensive plan amendments, rezoning, subdivision regulation, and land divisions, including public notice and hearing requirements, and establishes standards for zoning variances and appeals to boards of adjustment.

• Creates transfer of development rights provisions allowing counties to authorize movement of development potential from sending properties (floodplains, historic sites, high-noise military zones) to receiving properties with property owner consent.
