SB 1210 Summary

• Changes first-time DUI sentencing from suspension of all but 24 hours to suspension of all but 10 days if the defendant completes a court-ordered alcohol or drug screening, education, or treatment program.

• Modifies second DUI offense sentencing (within 84 months) to allow suspension of all but 30 days of the required 90-day jail sentence upon completion of a court-ordered alcohol or drug program.

• Maintains requirement that defendants serve a minimum consecutive jail time (10 consecutive days for first offense, 30 consecutive days for second offense) before any suspension is possible.

• Keeps existing penalties for DUI convictions including fines ($250 minimum for first offense, $500 minimum for second offense), assessments, community restitution, ignition interlock device requirements, and driving privilege revocation for second offenses.
