SB 1229 Summary

• Allows labor organizations to require nonunion employees in a collective bargaining unit to pay for actual costs of grievance representation, capped at the amount of member dues during the most recent contract period.

• Defines "actual costs of grievance representation" as expenses for representing nonmembers in employment grievances, including labor organization staff time, transcripts, attorney fees, and arbitrator costs, but excluding political activities and internal union matters.

• Permits employees to reimburse representation costs through monthly payments equal to normal membership dues until the full amount is paid.

• Allows labor organizations to file a lawsuit for payment if the employee fails to begin reimbursing within 30 days after the final grievance decision.

• Preserves the right of nonunion employees to represent themselves or retain their own legal counsel in grievance proceedings.
