Prohibits operating a motor vehicle on a highway while using a handheld cellular telephone or personal digital assistant to write, send, or read written messages.

Exempts emergency vehicles, law enforcement officers performing duties, persons reading/entering phone numbers for calls, and vehicles not in motion and not in traffic lanes.

Establishes civil penalties of $50 for violations not involving accidents and $200 for violations involving motor vehicle accidents.

Provides a one-month warning period from January 1-31, 2011 during which law enforcement may only issue warnings for violations.

Takes effect December 31, 2010, and may be cited as the "No texting while driving act."
