Requires individuals and entities to destroy or arrange for destruction of all records stored on digital copy machines before assigning, transferring, selling or giving the machine to another person.

Defines "destroy" or "destruction" as erasing or modifying a record so it is unreadable, undecipherable or nonreconstructable through generally available means.

Violators are guilty of a class 1 misdemeanor.

Allows persons whose business or property is injured by a violation to bring a civil action in superior court to recover compensatory and punitive damages, plus reasonable attorney fees and costs.
