Courts must place individuals convicted of drug or paraphernalia possession on probation if the evidence was obtained during a drug overdose situation where the person needed medical assistance.

Probation requirement applies to two scenarios: when the defendant experienced a drug-related overdose requiring medical assistance, or when the defendant sought medical assistance in good faith for another person experiencing a drug-related overdose.

Section 13-901.01, subsection h, paragraph 4 restrictions do not apply to individuals eligible for probation under this new provision.

Upon successful completion of probation, the court must automatically set aside the conviction judgment pursuant to section 13-907.
