HB 2368 Summary

• Changes language in Arizona Revised Statutes sections 9-499.07 and 11-459 from "may" to "shall" regarding establishment of prisoner work, community restitution work and home detention programs by cities, towns, and county sheriffs.

• Allows cities, towns, and sheriffs to enter into joint exercise of powers agreements to use another jurisdiction's prisoner work, community restitution work and home detention program instead of establishing their own.

• Makes minor technical corrections including replacing "assure" with "ensure" in monitoring requirement language.

• Applies to both general home detention programs and specialized programs for persons sentenced for driving under the influence of alcohol or drugs under Arizona Revised Statutes sections 28-1381 and 28-1382.
