Employers must allow each employee at least one 30-minute meal break during every continuous 8 hours of labor performed.

Employers must allow each employee at least one 10-minute rest period during every 4 hours of labor performed, with no wage deductions for time spent in rest periods.

Exemptions apply to locations with only one employee and to employees covered under a collective bargaining agreement.

Employers may petition the Industrial Commission for an exemption if business necessity prevents providing these benefits, and the Commission may grant exemptions after conducting a hearing.

The Industrial Commission is required to adopt rules to implement the exemption process.
