HCR 2020 Summary

• Repeals Article VI, sections 36 and 41 of the Arizona Constitution, eliminating the commissions on appellate court and trial court appointments.

• Removes the merit-based nomination system requiring judicial commissions to submit candidates to the governor for appointment to appellate and trial court vacancies.

• Grants the governor power to appoint any person of the governor's choosing to fill judicial vacancies, subject to senate confirmation.

• Requires the governor to submit judicial nominees to the state senate for consent before appointment, with the senate able to reject nominations.

• Applies to justices and judges of the supreme court, intermediate appellate courts, superior courts, and other courts of record.
