Prohibits counties, municipalities, and other political subdivisions from adopting or enforcing local laws that criminalize or impose civil penalties for being in an intoxicated condition.

Removes language that previously allowed exceptions for "common drunkard" offenses and clarifies that intoxication alone cannot be the basis for local criminal or civil penalties.

Preserves existing state and local laws against driving under the influence, operating vehicles or equipment while intoxicated, and regulations on the sale and possession of alcoholic beverages.

Prevents local governments from using general laws to circumvent the prohibition on criminalizing public intoxication.
