SB 1219 Summary

• Allows groundwater to be transported outside groundwater basins and the upper San Pedro water district during declared emergencies, subject to director approval.

• Requires the governor to declare an emergency due to lack of precipitation or water shortage, and limits transfers to existing wells as of the emergency declaration date.

• Mandates consent from affected cities, towns, counties, and political subdivisions before groundwater withdrawal and transfer occurs.

• Restricts transported groundwater to domestic purposes, stock watering, and potable municipal water service only, and prohibits use within active management areas.

• Approvals valid for six months (extendable one additional six-month period) and must cease immediately upon expiration or revocation; effective retroactively from April 30, 2011.
