SB 1420 Summary

• Amends intergovernmental agreement filing requirements by requiring agreements submitted to the attorney general to be filed with the secretary of state, and agreements affecting only one county to be filed with the county recorder.

• Clarifies that intergovernmental agreements and contracts between school districts or between a school district and other governing bodies are exempt from competitive bidding requirements under state board of education procurement rules.

• Allows school districts party to intergovernmental agreements to extend agreement duration by notification to the secretary of state, with each extension not exceeding the duration of the previous agreement.

• Modifies section 15-213 to retain existing procurement practices for school districts while maintaining consistency with state procurement laws in title 41, chapter 23.

• Repeals conflicting amendments to section 15-342 from prior legislation and establishes an effective date of June 30, 2013.
