SB 1545 Summary

• Amends Arizona Revised Statutes by adding Chapter 3 to Title 30 regarding intrastate nuclear reactor fuel production.

• Declares that nuclear reactor fuel produced entirely within Arizona's boundaries using equipment manufactured or obtained entirely within the state has not entered interstate commerce and is therefore not subject to federal regulation.

• Defines "nuclear reactor fuel" as any material that can be consumed to derive energy through nuclear fission, and establishes that production includes mining, extraction, milling, conversion, processing, enrichment and fabrication of uranium ore.

• States that basic materials and generic/insignificant parts (such as screws, nuts, bolts) used in fuel production do not subject the fuel to federal regulation under interstate commerce authority.

• Applies these provisions to nuclear reactor fuel produced on or after September 30, 2011, asserts state authority over intrastate commerce based on the Ninth and Tenth Amendments to the U.S. Constitution.
