Prohibits smoking in a motor vehicle when a person under 16 years of age is present in the vehicle.

Law enforcement officers cannot stop a vehicle solely for violating this section; they must have reasonable cause to believe another motor vehicle law violation has occurred.

First violation results in a civil penalty of $50 per minor in the vehicle; subsequent violations increase to $100 per minor in the vehicle.

Violations are classified as nonmoving civil traffic violations.
