• Repeals and reinstates section 36-2901.04 of Arizona Revised Statutes, establishing a streamlined medical expense deduction eligibility process to be implemented by October 1, 2012.

• Requires applicants to have family income not exceeding 40% of federal poverty guidelines after deducting allowable medical expenses and family resources not exceeding $100,000 net worth (including $5,000 in liquid assets).

• Allows applicants to use unreimbursed medical expenses incurred by family unit members during a three-month period (month before application, month of application, and following month) to reduce income to the required level.

• Grants eligibility beginning when spend down is met or on the first day of the application month (whichever is later) for a continuous period of five months plus remaining days, not to exceed six months total.

• Exempts the Arizona Health Care Cost Containment System Administration from rule-making requirements of state law for one year following the act's effective date.
