Amends Arizona Revised Statutes section 28-1381 to modify jury trial rights in DUI cases by requiring that defendants be informed they may request a trial by jury only if the state alleges a prior conviction.

Changes language from "if the state alleges a prior conviction" to clarify when jury trial rights apply in driving under the influence prosecutions.

Applies retroactively to December 31, 2011, but does not apply to cases where trial commenced or defendants pleaded guilty/no contest between December 31, 2011 and the effective date.

Designated as an emergency measure operative immediately upon passage.
