AZ HCR2003

Proposes constitutional amendment to redirect all punitive or exemplary damages awarded in civil cases to an education fund for kindergarten through grade 12 schools.

Amends Arizona Constitution Article II, Section 31 and Article XVIII, Section 6 to require punitive damages be deposited in a fund established by law rather than awarded to plaintiffs.

Creates a new "punitive or exemplary damage awards fund" to be administered by the Arizona Department of Education, with monies continuously appropriated and exempt from appropriation lapsing provisions.

Requires court clerks to deposit all punitive or exemplary damage awards into the fund instead of distributing them to plaintiffs in civil cases.

Directs the Secretary of State to submit these propositions to voters as separate ballot measures at the next general election.
